WINKLER ARTS + CULTURE — FACILITY RENTAL AGREEMENT
547 Park Street, Winkler, Manitoba
Version 2026-10 — Approved
1. REQUESTS AND CONFIRMATION
Submitting a rental request does not reserve the date. A booking is confirmed only when WA+C approves the request, the renter accepts these terms, the required refundable damage deposit is received (unless WA+C approves an exception), and any other conditions are satisfied. Changes to the event or hours require prior approval.
2. FEES AND PAYMENT
Rental charges depend on package, hours and selected services. No tax is added to rental estimates. Following approval, the refundable damage deposit secures the date. The remaining rental and service balance is due 14 calendar days before the event; for requests made within 14 days, the balance must be paid before the event begins, at a deadline confirmed by WA+C. The Executive Director may approve alternative payment or invoicing arrangements. Additional approved time, services or damage may be charged separately.
3. REFUNDABLE DAMAGE DEPOSIT
Upper Gallery: $100, waived for qualifying small meetings during staffed hours.
Basic: $250. Wedding: $250. Social Event: $500.
Deposits are normally refunded within one week after the event, following inspection and reconciliation. WA+C may deduct reasonable, documented costs for damage, additional cleaning, unpaid charges, or other charges permitted under this agreement. Any deductions will be communicated to the renter, and the remaining balance will be refunded.
4. CANCELLATION
Renters must notify WA+C as soon as possible if they need to cancel. The following cancellation fees apply:
- More than 30 days before the event: no cancellation fee.
- 7–30 days before the event: $50 cancellation fee.
- Fewer than 7 days before the event: $100 cancellation fee.
WA+C will refund payments received, less the applicable cancellation fee and any reasonable, documented, non-recoverable expenses specifically incurred for the booking and disclosed or agreed to in advance. Cancellation fees will not be charged twice. If WA+C cancels because the facility is unavailable, payments for services not provided will be refunded or an alternative date may be offered. Any refunds remain subject to applicable law.
5. FACILITY USE
Renters are responsible for their guests, contractors and participants. Respect occupancy limits, artwork, equipment, furnishings, exits and accessibility routes. Do not move artwork or equipment without permission. Follow WA+C staff instructions. The facility may be used only for the approved purpose and hours.
6. SETUP AND CLEANUP
All decorating, setup, cleanup and removal of belongings must fit within approved access hours unless otherwise arranged. Optional WA+C setup/cleanup is $100 when selected and accepted. The renter must leave the premises orderly. Extra cleaning or unauthorized overtime may result in charges.
7. INSURANCE AND LIABILITY
Renters must maintain third-party liability insurance of at least $1,000,000 for their event unless the Executive Director approves an exception. Proof is required at least 30 days before the rental unless WA+C agrees otherwise, including for short-notice bookings. Renters are responsible for damage caused by their event participants. WA+C is not liable for personal property loss except where required by law.
8. ALCOHOL
Alcohol may only be served with prior WA+C approval and in accordance with applicable Manitoba laws, licensing requirements, and WA+C policies.
When WA+C provides licensed bar service, WA+C is responsible for the applicable liquor licence and certification requirements for its service. Renters are not required to provide their own liquor permit or Smart Choices certificate solely for WA+C-operated bar service.
When renters arrange their own alcohol service, they must provide any required permits, licences, and proof of appropriate Smart Choices certification, as applicable, before the event.
All alcohol arrangements are subject to WA+C approval and verification that the service is permitted under the applicable license. WA+C may refuse or stop alcohol service if requirements are not met.
9. SALES AND FUNDRAISING
Sales, fundraising and donation collection require prior approval. Any applicable commissions or other conditions must be agreed in writing before the event.
10. ADDITIONAL SERVICES
Subject to availability and approval: bartender $50/hour, PA system $25 for half day or less or $50 for full day, and WA+C setup/cleanup $100. Technical assistance is not offered. Additional services and event-specific requirements must be confirmed by WA+C.
11. SAFETY AND CONDUCT
Unsafe or illegal activities, harassment, discrimination or behaviour that threatens guests, staff, artwork or property are prohibited. WA+C may intervene or end an event for serious safety or conduct concerns, subject to applicable law.
12. UNFORESEEN EVENTS
If circumstances outside WA+C's reasonable control prevent use of the premises, WA+C may offer an alternate date or refund payments for services not provided, subject to applicable law.
13. ELECTRONIC ACCEPTANCE
By checking the agreement box and submitting a request, the renter confirms they have read these terms, understand the estimate and payment schedule, and acknowledge that the booking is not confirmed by submission alone. WA+C records the accepted agreement version and timestamp. Material changes require renewed acceptance.
